What is Telehealth?
Telehealth involves the use of electronic communications and information technologies to provide healthcare services when you and your healthcare provider are in different locations. At Vitäal Health, telehealth services include online medical questionnaires, asynchronous review of your information by licensed physicians, secure messaging with providers, electronic prescribing, and follow-up care.
Your Consent to Telehealth Services
By clicking "I Agree" or proceeding with your medical questionnaire, you are providing informed consent to receive healthcare services via telehealth from independent, licensed healthcare providers through the Vitäal Health platform.
You acknowledge and understand that:
- A licensed healthcare provider will review your information asynchronously (not in real-time)
- The provider will determine whether tadalafil is medically appropriate based on your medical history
- You may be contacted if additional information is needed
- The provider may decline to prescribe medication if not medically appropriate
- There is no guarantee that you will receive a prescription
- Alternative methods of care are available, including in-person consultations with local healthcare providers
- You may withdraw your consent to telehealth services at any time
- Withdrawal of consent does not affect services provided before withdrawal
Benefits of Telehealth
Telehealth offers potential benefits including: convenient access to healthcare providers without traveling; discreet consultations from home; faster prescription processing and delivery; and often lower cost than traditional in-person visits.
Limitations and Risks of Telehealth
You acknowledge that telehealth has certain limitations and potential risks:
- No Physical Examination: The provider cannot perform a physical examination, which may limit their ability to diagnose certain conditions
- Limited Assessment: The provider relies solely on the information you provide and cannot observe physical symptoms
- Not for Emergencies: Telehealth is not appropriate for emergency situations or urgent medical conditions
- Diagnostic Limitations: Some conditions require in-person evaluation, laboratory tests, or imaging studies
- Technology Failures: Equipment malfunctions, software issues, or connectivity problems may disrupt consultations or cause delays
- Security Risks: Despite security measures, there is a possibility of unauthorized access during electronic transmission
- Delayed Diagnosis: Lack of physical examination may delay diagnosis of underlying conditions
- Medication Risks: All medications, including tadalafil, carry potential side effects and risks
- No Results Guaranteed: No specific medical outcomes can be guaranteed
Your Responsibilities
By consenting to telehealth services, you agree to:
Provide Accurate Information
- Answer all questions truthfully and completely in your medical questionnaire
- Disclose all current medications, supplements, and medical conditions
- Provide accurate contact and shipping information
- Update your medical information if your health status changes
- Inform your provider of any allergies or adverse reactions to medications
IMPORTANT: Withholding or providing inaccurate information about your health may result in serious harm, including, in some cases, death.
Appropriate Use
- Use telehealth services only for appropriate, non-emergency medical situations
- Follow all instructions provided by your healthcare provider
- Take medications only as prescribed
- Seek in-person medical care when recommended or if your condition worsens
Emergency Situations
- DO NOT use telehealth services for medical emergencies
- Call 911 or go to the nearest emergency room for urgent or life-threatening conditions
- If you are experiencing a life-threatening situation such as contemplating suicide, call 911 or the 988 Suicide & Crisis Lifeline
Provider Qualifications
All healthcare providers accessible through Vitäal Health are licensed physicians or nurse practitioners authorized to practice medicine in your state. Providers are independent practitioners, not employees of Vitäal Health, and exercise their own medical judgment in determining appropriate treatment. Providers may decline to prescribe medication if they determine it is not medically appropriate.
Privacy and Security
Data Protection and HIPAA
The independent healthcare provider who conducts your consultation is a HIPAA covered entity and must protect your Protected Health Information (PHI) according to federal regulations. The provider will make their Notice of Privacy Practices available to you.
Vitäal Health LLC is not a HIPAA covered entity. However, we implement enterprise-grade security measures to protect all information:
- Encryption in transit (TLS 1.3) and at rest (AES-256)
- Secure, access-controlled databases
- Business Associate Agreements with all service providers who may access health-related information
- Regular security audits and penetration testing
By consenting to this telehealth consultation, you authorize:
- Vitäal Health to share your medical questionnaire, health information, and account details with the independent healthcare provider for evaluation and treatment
- Vitäal Health to share your prescription information (if prescribed) with our pharmacy partner for fulfillment
- The healthcare provider to communicate with you through the Vitäal Health platform regarding your treatment
- Sharing of your information as required by law or for treatment, payment, and healthcare operations
Your information will be shared ONLY with:
- Your assigned healthcare provider
- The pharmacy fulfilling your prescription (if prescribed)
- Service providers under Business Associate Agreements (as needed for platform operation)
- As required by law or court order

Prescriptions and Medication
Prescription Decisions
- Prescription decisions are made solely by the healthcare provider based on their independent medical judgment
- There is no guarantee that you will receive a prescription
- The provider may require additional information before prescribing
- The provider may recommend alternative treatments or in-person evaluation
If a Prescription is Issued
- Your medication will be dispensed by a licensed, accredited pharmacy
- You will receive the medication directly at your shipping address
- Review all medication information and instructions upon receipt
- Contact your provider if you have questions or experience side effects
Medication Safety
- Take medication only as prescribed
- Read and follow all medication instructions and warnings
- Do not share your medication with others
- Store medication safely and properly
- Report any adverse reactions or side effects to your provider immediately
Technical Limitations and Disclaimer
You understand and acknowledge that:
- The delivery of healthcare services via telehealth is an evolving field and technology may be updated over time
- Technical failures, including equipment malfunctions, software errors, or connectivity issues, may occur and result in loss of information, delay in care, or interruption of services
- Vitäal Health uses reasonable measures to prevent technical failures but cannot guarantee uninterrupted service
- You agree to hold Vitäal Health harmless for any loss of information or delay in care resulting from technical failures beyond our reasonable control
- While telehealth may provide potential benefits, no specific results can be guaranteed
- Your condition may not be cured or improved, and in some cases may worsen

Withdrawal of Consent
You may withdraw your consent to telehealth services at any time by notifying us in writing at support@vitaalhealth.com or canceling your subscription through your account. Withdrawal of consent does not affect the validity of any services provided before your withdrawal, and you remain responsible for any outstanding fees. This consent will be considered renewed upon each new telehealth consultation with a provider.

Acknowledgment and Agreement
By clicking "I Agree," checking a related box to signify your acceptance, or otherwise using Vitäal Health's telehealth services, you acknowledge and agree that:
- You have read and understood this Telehealth Consent
- You have had the opportunity to ask questions about telehealth services
- You understand the benefits, limitations, and risks of telehealth
- You voluntarily consent to receive healthcare services via telehealth
- You understand that alternative in-person care is available
- You understand that you may withdraw your consent at any time
- You will provide accurate and complete medical information
- You understand that withholding information may result in serious harm
- You will follow all instructions and recommendations from your provider
- You will seek in-person care when appropriate or recommended
- You agree to hold Vitäal Health harmless for technical failures beyond our reasonable control
- You understand that there is no guarantee you will receive a prescription
- You understand that your provider makes all medical decisions in their independent professional judgment
- You understand that telehealth is intended for ongoing management of stable conditions and you should maintain a relationship with a primary care physician for comprehensive healthcare
